Like most people, our clients like to know what to expect when it comes to installation. Listed below are our detailed terms and conditions. Clients are required to read and sign these prior to paying a deposit on their estimate.
Flooring + Installation Agreement
Thank you for choosing Miller’s Wholesale Flooring LLC for your flooring needs. We appreciate the support and are committed to providing exceptional service.
The following is our agreement for installation. For value received we, you + Miller’s Wholesale Flooring LLC, agree as follows:
If you do not turn in a signed terms and condition agreement, your deposit on flooring will serve as your agreement to these terms and conditions.
Purchase of Flooring
The Description of the flooring you are purchasing is detailed on your Estimate/Invoice. By Signing below, the client is indicating that they have read and reviewed the Estimate closely, and that the details are all correct. If a client intends to measure their own space and is only purchasing a floor with no installation, there will be no returns or refunds. If for any reason we accept the return, there will be a 40% Restocking fee.
Furniture + Fixtures
If there are any pieces of furniture to be moved for installation that were not there at the time of the estimate, it is the client's responsibility to get it moved, or to make sure we are aware so we can have the manpower to handle it. Client is responsible for moving all breakables, frames, and other small items out of the installation area.
Fees for moving Sofas, Beds, Appliances, and other large items like washers and dryers are priced PER ITEM
Please note we do not move items such as fish tanks, waterbeds, and gun safes.
Fees for items such as Pianos, Grandfather Clocks, Pool Tables or Saunas, Tanning Beds ETC.) will be considered on an individual basis.
We do not move items that are fixed to the floors, walls, or ceilings. (i.e. Vanities, Water lines,pedestal, Islands, or any items with any kind of hook up)
PLEASE NOTE: OUR INSTALLERS TAKE EXTREME CAUTION WHILE MOVING ITEMS, HOWEVER ALL ITEMS ARE MOVED AT THE CLIENTS OWN RISK.
Electrical and Appliances
Our installers do not remove or replace any appliance that is hardwired or connected to any water lines. (i.e. Dishwasher or Range)
If our installers move a washer/dryer/refrigerator Client is responsible for detaching and reattaching any water lines. If a client is unable to do so, the client is responsible for locating and hiring someone who can, or making arrangements with us prior to install so we can help make arrangements. This must be detailed in the estimate if we are to detach/reattach any lines for the client.
Plumbing
Our installers will remove and set a toilet for the fee listed directly in your estimate. Our installers are not responsible for pulling/setting any toilets not listed directly on the estimate.
Communication/Installation
An adult aged 18 or over is preferred to let the installers in, but not required. If a client will not be present while installation is being completed, we must have a phone number in which to contact incase questions or problems arise. If we are unable to reach you it will either delay installation or we may make a reasonable decision on how to proceed, which could mean additional charges such as additional floor prep, etc.
Pets
Client is Responsible for securing all pets prior to installer’s arrival and for the duration of the installation.
Power and Room Temperature
Electrical Power MUST be available at the jobsite.
Carpet: Job site must be complete with carpet being the last to be installed
Hardwood: Job site must be acclimated to normal living conditions 3 days before the wood is installed
Luxury Vinyl: Must be kept and installed in a climate controlled environment *Ranging from 55F-85F.*
Demo of Old Flooring
Demo and Disposal of any kind should be addressed at the time of the estimate and be included as its own line item on your Estimate. Any demo and disposal beyond what is listed in the original estimate is subject to additional charges. If any extra charges apply, the client will be notified at once. The client will then have the option of accepting the additional charges, or doing the demo on his/her/their own.
Dust/Debris
Flooring installation requires the use of tools such as an oscillating saw, table saw, miter saw, and other materials that will cause dust/debris.There will be dust in the areas the installers are working and likely throughout the house. The installers will be diligent about keeping it contained, but the client is responsible for covering any furniture, clothing, household items prior to installation if they wish to keep it free of dust and debris. Client is to prepare the area prior to installers arriving if they wish to cover things with a plastic or tarp. Client is responsible for securing any tarp/plastic from falling/moving. Installers will not be responsible for any dust on any areas not covered/protected by the client.
Installation Preparation:
The areas of Installation are specifically identified on your Estimate. If a client would like to add an area of install that was not on the estimate, it is to be addressed at least 2+ weeks prior to the set date in order to have enough time to order extra materials and adjust our calendar accordingly. Installation by Miller’s Wholesale Flooring includes light prep such as a light sanding of subfloor joints, and vacuuming the installation area. Miller’s Wholesale Flooring is not responsible for correcting any subfloor unevenness unless specifically mentioned in the estimate.
Additional Charges
Miller’s Wholesale Flooring is not responsible for any unforeseen circumstance that may arise. We make every effort to include every item we can, however it is impossible to predict some things. IE: Installers demo old linoleum and find holes in the subfloor, which will need to be patched before installing new floor, Subfloor unevenness larger than ⅜”, rotten subfloor, floor joist, mold etc.
Stairs:
There are many different ways to install steps. Be sure to discuss with Miller’s Wholesale Flooring LLC which method you prefer. We do not do steps, however, If we are doing custom work near the steps, we need to have the details on stain color, tread type, and stair nose preference all before the date of installation. If you need a recommendation on someone to do a set of steps, we are happy to supply a number to you. Feel free to ask!
Trim Work
Any removal of trim or base should be handled before installation, unless your estimate states otherwise. Although our installers are careful during removal if we are reusing trim, the materials could still be damaged. If so we will contact you to see how you wish to proceed, however know there could be additional charges if we have to replace any pieces. Miller’s Wholesale Flooring is not responsible for replacing any damaged trim due to original installation method, age, material.
Installation Dates
Estimated start and finish dates are TENTATIVE. Many circumstances during the day can cause crews to run ahead or behind schedule. We will do our best to notify you on any time changes. Once a date is given to you, that date will stay the same and you should expect an installer's arrival on that date, UNLESS YOU ARE CONTACTED DIRECTLY.
Natural Products
Any product made from natural materials (Solid Hardwood, Engineered Hardwood, and Waterproof Hardwood) have a natural variation. Clients should expect natural variations- these are not defects, and no refund or replacement will be made for natural products that have normal color, texture, and appearance variation.
Defective Flooring
Rare situations arise, but if we determine that a floor may be defective we promptly send out a representative for whichever brand client had installed to do a warranty claim. They then follow up with us and we return with the results.
Miller’s Wholesale Flooring LLC is not responsible for any monetary compensation that relates to the defectiveness in the flooring as it is in the hands of the manufacturer.
Job Completion/Payment
Our installers are expected to clean up and remove all trash they contributed to the job site. If We are called back to a job to remove paint spots from painters, drywall mud, or scratches/defects due to client/Contractor there will be at least $150 trip fee to assess/fix damage.
Payment is due immediately upon completion of the job. Jobs done in phases will be billed for the work completed to date. If client will not be home at the time of completion, please be sure to make payment arrangements to pay by bank transfer, or mail a check in advance. If Payment arrangements are not made prior to job completion, the client will be subject to interest on the remaining balance. If payment is not made by the due date, interest will be charged 14% on the remaining balance of the ticket.

Warranty
We offer a No Charge 12 month installation warranty where we will correct any installation issues that may have occurred unknowingly. We do not warranty floor separation on any type of floating floor if cabinets/vanities are placed on top, a wheelchair, rolling desk chair, or walker is used. Miller’s Wholesale Flooring will fix the separation for a fee that will be on a case by case basis.
All flooring and material warranties are upheld through their manufacturing brand. Any defects, and issues should be reported to that brand representative so they can make a claim to the manufacturer. If you have any questions on your particular warranty for your materials, we would be happy to direct you to find all the information you need.
The No Charge 12 month installation warranty does not cover separation due to subfloor issues, and those will be priced on a case by case basis.
LIMITATION OF REMEDIES AND DISCLAIMER OF WARRANTIES. WE WILL NOT BE LIABLE IN ANY CASE FOR ANY LOSS OF SPECIAL, INCIDENTAL, CONSEQUENTIAL, INDIRECT, OR PUNITIVE DAMAGES. IN NO EVENT SHALL OUR LIABILITY EXCEED REIMBURSEMENT OF ANY MONIES PAID BY YOU UNDER THIS AGREEMENT AND THIS SHALL BE YOUR EXCLUSIVE AND SOLE REMEDY FOR ANY CLAIM HEREUNDER. THE FOREGOING LIMITATION SHALL NOT APPLY TO CLAIMS FOR PERSONAL INJURY. THE LIMITATIONS, EXCLUSIONS AND DISCLAIMERS IN THIS SECTION AND ELSEWHERE IN THESE TERMS OF USE APPLY TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW
